1.1. These Purchase Terms regulate the purchase conditions of the products purchased by the Customer in the Online Store of the website www.notejido.com (hereinafter, the “Online Store”), owned by Diseño y Aplicaciones del Notejido S.L. (hereinafter “DISEÑOS NT” or “We”) with CIF B-23258635, and registered office at Pol. Ind. El Chaparral s/n, 23692 Santa Ana, Alcalá la Real (Jaén), Spain.
For the above purposes, Client is understood as any person who acts in the field of their commercial, business, trade or profession activity, not carrying out transactions with consumers and users.
1.2. DISEÑOS NT reserves the right to decide at any time the Products offered to Clients. In this way, DISEÑOS NT may, at any time, add new Products to those included in the Online Store, understanding, unless otherwise provided, that such new Products will be governed by the provisions of the Terms and Conditions in force at that time. moment. Likewise, DISEÑOS NT reserves the right to stop providing access, at any time and without prior notice, to any of the Products offered in the Online Store.
*The manual manufacturing process of those products that are sewn may be subcontracted, with subsequent quality control in our facilities.
2.- How to buy?
The Client can process the order through the following channels:

The prices of all products are shown in euros, showing the breakdown of the amount of the tax base and indicating the VAT rate separately.
2.1. Through the Web.
Yo. In order to acquire the Products in the Online Store, it is necessary to have previously registered in the Account. You must follow the instructions that appear on the screen and accept the purchase by complying with the aforementioned instructions. This in turn means that you have read and accepted the Purchase Terms and the Data Protection Policy. These conditions are available by clicking on them.
ii. When you have selected the Product you wish to buy, you can add it to the shopping cart, without any commitment to purchase, by clicking on the [Add to cart] button. At any time you can view the basket by clicking on the upper right button with the basket symbol. Any selected item can be removed from the shopping cart by clicking on the [x] button.
iii. The prices of the Products shown in the Online Store will be expressed in euros and include applicable taxes. Transportation and shipping costs will be applied to product deliveries and will be shown when applicable.
IV. If you wish to continue with the purchase process of the items selected in the shopping cart, you must click on the [Process order] button. Later we will ask you for shipping and billing information.

Both the order information and the Terms of Purchase are included in the order confirmation that we send you by email, and can be easily printed or saved with your email. You can also download the Terms of Purchase independently by accessing through the link provided and using the browser commands to save the document.
2.2. via email
The acceptance of an order by the Client implies full acceptance of the budget or proforma that has been sent to him.
All prices are correct except for misprints. DISEÑOS NT reserves the right to change prices or conditions without notifying third parties and the price in force on the date of issue or shipment will apply.
The confirmation of the order supposes the authorization of use of the final product as an example of articles manufactured / personalized by DISEÑOS NT.
The samples will be charged at the rate price plus freight. In case of return, the procedure is the same as a normal order.
2.4. Tolerance in qualities of the finished product.
As far as gloss, hardness, satin and weight are concerned, those variations that represent prudential differences that are not very visible to the eye will be admissible.
The dimensions indicated for the articles refer to external measurements and variations of around 3% will be admissible.
In different productions, the color tones of the support and/or inks are likely to suffer slight differences admitted in the graphic arts and textile industry sectors.
In prints on supports other than white (kraft paper, non-woven in dark colors) they can distort the color of the pantones.
3.- Payment conditions.
The prices of the services are expressed in Euros (€), including taxes and management and shipping costs, the amount of which will be indicated at the time of the final confirmation of each order.
NT Designs may periodically offer discount codes to its Clients. Said discounts may only be applied in accordance with the instructions specified by NT Designs with respect to each code, and in any case, Clients may only use a single code per order.
The lack of payment by the Client or the disclosure of its insolvency will grant NT Designs, in addition to the rights to carry out the pertinent legal actions, the cancellation of the fulfillment of its contractual commitments with the Client.
After the payment is made, the Customer will receive an order confirmation e-mail, which will include a summary of the items purchased and the destination address.
3.2. Payment methods.
Payment must be made by the Client in advance and for the total amount of the invoice. Said amount is the result of the sum of the tax base plus the value of the VAT. In the Canary Islands, Melilla, Ceuta and the European Union, they will be exempt from this fee.
At Diseños NT we offer you different forms of secure payment, depending on the purchase channel.
(i) Through the Web.
The payment method will be 100% in advance before shipment through the payment methods defined on the Web, currently:
• Credit card.
If at the time of payment there is an incident that prevents payment, the customer will receive an automatic payment error message and their order will not be processed until the payment process is successfully completed.

The payment will not be valid until the amount paid is taken into account.
The payment will be considered made when the total amount is received in the NT Designs bank account. In case of bank transfer, in this modality, the payment will be considered made when it is received in the NT Designs bank account. If you want to speed up the process, please send us proof of having made the transfer, (only the official of the entity is valid).
4.1. Delivery conditions.
Unless other conditions are specified in writing at the time of the order, the goods will be shipped freight prepaid to the following destinations: Spain (Peninsula and Balearic Islands) and Portugal. Prices include postage paid to an agreed destination and export clearance from the Peninsula.
For foreign destinations or outside the peninsula it will be issued postage due.
Below is the rate chart for all shipments:
Minimum order excluding VAT.
For territories or countries that involve customs clearance (Canary Islands, Ceuta, Melilla and countries outside the European Union), the export customs clearance will be included in the cost of transport or in the price of merchandise.
Import clearance costs will not be included, as well as taxes and fees accrued DAP Conditions (Incoterms 2020) for the countries specified in the table.
The courier service is free based on the data in the table above, for orders that include non-woven and paper products, shipping will be free based on the prices established for paper.
Shipments to the Canary Islands, Ceuta and Melilla and foreign territories will be subject to additional charges specified at the time of purchase. In non-community shipments, the Canary Islands, Ceuta and Melilla, the charges corresponding to local taxes and entry customs clearance must be paid by the customer at the time of receiving the shipment.
These conditions will be applied to orders with a single delivery address. Special transports, deliveries to plants or subsoils or those that are urgent, will be carried out at the customer’s risk and expense. For more details, request information.
The services corresponding to the unloading of the merchandise from the trailers or trucks will be carried out by the Client, and the Client must provide the appropriate means for unloading said merchandise.
4.2. Delivery times.
The customer will take charge of the merchandise at the same time it is delivered to the agreed destination point and has signed the delivery document.
The delivery time is 48 hours (working days) for items in stock (items already manufactured and available in our warehouse) and will begin to compute from receipt of payment for orders received and processed before 11:00 a.m. for Spain, Balearic Islands and Portugal.
Delivery will be made through a courier service. For shipments to the Canary Islands, Ceuta, Melilla and internationally, the delivery time may be affected, increasing the usual deadlines for the rest of Spain. Consult in the case of the Canary Islands, Ceuta, Melilla and international territories. In the case of shipments destined for non-EU foreign territories, the delivery date may also be subject to obtaining export and/or import permits or any other administrative procedure.
DISEÑOS NT is exempt from liability if due to force majeure or circumstances not directly attributable to DISEÑOS NT the merchandise is delayed in its delivery. In this way, DISEÑOS NT is not responsible for the possible delay in the delivery of the merchandise caused by the transport company.
In case you have to make a Claim, please follow this procedure:
1. If upon receipt of the merchandise you notice that the packaging is damaged or the number of packages does not correspond to those that appear in the shipment, state it in the carrier’s delivery bulletin. In case you do not do so, we will not be able to take charge of any claim for this concept.
2. If after receiving the merchandise, you notice that it does not correspond to what was requested or you find any problem or defect, contact us by calling 953 581 683 or by email at email@example.com; Provide us with your data and the identification of the order and we will proceed to process your claim.
3. In the event that, once the claim has been processed, the return of merchandise is admitted, please state the claim number that we have previously provided.
The return of personalized products will only be accepted in the event that they present a printing or manufacturing defect attributable to NT Designs. Small variations in grammage, tonality, color, dimensions and/or satin typical of the textile industry and graphic arts will not be subject to claim.
To proceed with the return, the customer must notify it within a period of 15 calendar days from the receipt of the merchandise. After this period, no refund will be accepted. Returns must always be preceded by a written communication by the Client and these must be accepted by NT Designs. To formalize the return you must send an email to firstname.lastname@example.org.
• If the reason for the return is not attributed to our error, you will be charged 10% of the value of the merchandise plus the collection postage.
• Returns of goods without packaging or different from those sent by NT Designs will not be accepted or accepted.
• The payment will be made after verifying that the merchandise received corresponds to that indicated in the incident.
5.2.- Cancellations and/or modifications of the order.
Eventual cancellations or changes in any data of a placed order must be communicated to the company in a reliable way (in writing, fax or email) within 10 days immediately after the order confirmation, indicating the order number and it is an annulment or modification; Otherwise, the cancellation will imply a penalty for the client equivalent to at least (depending on the state of the manufacturing) 50% of the value of the merchandise.
If you contract as a consumer and user, DISEÑOS NT offers you the legal guarantee on the Products purchased, for the lack of conformity of the same that is manifested within a period of two (2) years from the delivery of the Product.
In accordance with current legislation, it will be understood that the Products are in accordance with the contract provided that they meet the following requirements:
a) They conform to the description made by DISEÑOS NT and possess the qualities of the Product presented in the Online Store.
b) They are suitable for the uses to which products of the same type are ordinarily destined.
c) Present the usual quality and features of a product of the same type that the Customer may reasonably expect, taking into account the nature of the product and the advertising and labeling.
In the event that any of the Products does not comply with the Purchase Terms, you must notify us through the means of communication indicated in clause 5 (Claims).
7.- Modification of the conditions.
Due to changes in our commercial policy or because the law imposes it on us, we may make changes to the Online Store and the Purchase Terms at any time. Please note that when you buy, We will apply the Terms of Purchase in force at the time you place the order, unless, by law or by request of public authorities, We must make a change to these Terms and Conditions of Contract.
If any of these conditions is declared invalid, null or for any reason ineffective, said condition will be understood to be excluded without said declaration affecting the validity or enforceability of the rest of the conditions.
8.- Legislation and applicable jurisdiction.
These Terms and Conditions are subject to Spanish law. In case of litigation, the buyer, expressly renouncing the jurisdiction that may correspond to him, expressly submits to the Courts and Tribunals of Alcalá la Real (Jaén).
9.- INTELLECTUAL / INDUSTRIAL PROPERTY RIGHTS
The intellectual or industrial property rights which may protect the images, logos, designs or texts that the client makes available to the company for their reproduction, are the client’s ownership, as expressed. Or, in another case, the client expresses to have the license which allows for their reproduction. In any case, the client expressly assumes the liability to third parties or to the company itself, which may derive from the reproduction of said images, logos, designs or texts whose materialization is assigned in this act to the company.
Once the final product is finished, the client authorizes the company to include it in its samples and/or catalogue (in physical, digital or web format, or any other kind of format), with the only purpose of showing it to third parties as an example of its manufactured products.
